Acceptance of Terms
By creating an account, accessing, or using MyMT Manager ("MyMT," "the Service," "we," "us," or "our"), you ("you" or "User") agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service.
If you are under 18 years of age, you must have a parent or legal guardian review and agree to these Terms on your behalf before you use the Service.
Description of Service
MyMT is a web-based informational tool designed to help prospective college students and their families research, organize, and track applications to BFA Musical Theater (and Acting) programs. The Service provides a database of school and program information, organizational tools for tracking applications, and related features.
MyMT is an informational and organizational tool only. It is not an admissions consulting service, and it does not guarantee admission to any program. We have no affiliation with any college, university, or program listed in our database unless explicitly stated otherwise.
Account Registration and Security
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.
3.2 One Account Per Person
Each account is for a single individual's personal use. You may not create multiple accounts for yourself, and you may not create accounts on behalf of others (except that a parent or guardian may create an account for the purpose of assisting their own child).
3.3 No Account Sharing
Your account is personal to you and may not be shared with any other person, including but not limited to coaches, acting teachers, college counselors, consultants, or other families. Sharing your login credentials with anyone else is a violation of these Terms and may result in immediate account suspension or termination.
3.4 Coach and Counselor Accounts
Coaches, acting teachers, college counselors, and similar professionals ("Coach Users") may create their own accounts subject to the following restrictions:
- Student account required. Coach Users may only use the Service in conjunction with students who maintain their own active MyMT accounts. The Service is not a substitute for individual student accounts.
- No proxy lists. Coach Users may not create or maintain school lists, application trackers, or other organizational data on behalf of students who do not have their own accounts. Building or managing lists for individual students who have not independently signed up for MyMT is a violation of these Terms.
- Personal use only. A Coach User's account is for that individual's own professional reference and use. It may not be shared with other coaches, staff members, or colleagues.
We reserve the right to suspend or terminate any Coach User account that we reasonably believe is being used to circumvent the requirement for individual student accounts.
3.5 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at the contact information below if you become aware of any unauthorized use of your account.
Acceptable Use
When using the Service, you agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or any systems or networks connected to the Service.
- Use any automated system, including but not limited to bots, scrapers, crawlers, spiders, or any other automated means, to access or collect data from the Service.
- Access, query, or interact with any application programming interface (API) associated with the Service except through the standard user interface provided by MyMT. Reverse-engineering, decompiling, or attempting to discover any API endpoints is prohibited.
- Copy, reproduce, distribute, republish, download, scrape, or store any substantial portion of the data, content, or information available through the Service for any purpose, including building a competing product or service.
- Interfere with or disrupt the Service, servers, or networks connected to the Service, including by transmitting viruses, malware, or any other harmful code.
- Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
- Use the Service to send unsolicited communications, promotions, or advertisements.
- Circumvent, disable, or otherwise interfere with any security-related features of the Service.
- Resell, sublicense, or commercially exploit the Service or any data obtained from it without our prior written consent.
Data Accuracy and Limitations
5.1 Program and School Information
We make reasonable efforts to keep our database of school and program information accurate and up to date. However, the information in the Service is gathered from publicly available sources and may contain errors, omissions, or outdated details. Program requirements, deadlines, audition formats, tuition, financial aid information, and other details can and do change without notice.
You are solely responsible for verifying all information directly with the relevant institution before making any decisions based on data found in MyMT. We strongly encourage you to visit official school websites and contact admissions offices to confirm any information that is important to you.
5.2 No Professional Advice
Nothing in the Service constitutes admissions advice, financial advice, legal advice, or any other form of professional guidance. MyMT is a tool to help you organize your own research — it is not a substitute for professional consultation.
Intellectual Property
6.1 Our Content
The Service, including its design, features, functionality, text, graphics, logos, and software, is owned by MyMT and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.
6.2 Your Content
You retain ownership of any personal data, notes, lists, or other content you create or upload to the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you.
6.3 Feedback
If you provide us with suggestions, ideas, or feedback about the Service, you grant us a perpetual, royalty-free, worldwide license to use, modify, and incorporate that feedback without any obligation to you.
Privacy and Data
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.
We will not sell your personal information to third parties. We may use aggregated, anonymized data (which cannot identify you personally) to improve the Service.
Payment Terms
Certain features of the Service may require payment of a fee. If applicable, fees will be clearly disclosed before you are asked to pay. All fees are non-refundable unless otherwise stated at the time of purchase or required by applicable law.
We reserve the right to change our pricing at any time. Any price changes will not affect fees you have already paid for a current subscription period.
Disclaimers and Limitation of Liability
9.1 "As-Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
We do not warrant that:
- The Service will be available at all times, or that access will be uninterrupted or error-free.
- The data or information provided through the Service will be accurate, complete, reliable, or current.
- The Service will be free of viruses, bugs, or other harmful components.
- Any defects in the Service will be corrected.
- The results obtained from using the Service will meet your requirements or expectations.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYMT, ITS OWNERS, OPERATORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.
OUR TOTAL AGGREGATE LIABILITY to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) fifty U.S. dollars ($50.00).
9.3 Specific Disclaimers
Without limiting the generality of the above, we are specifically not responsible for:
- Incorrect, incomplete, or outdated school or program information in our database.
- Missed deadlines, incorrect audition requirements, or other consequences resulting from reliance on information in the Service.
- Any loss of data, including your personal lists, notes, or other User Content, due to system failures, database corruption, or other technical issues.
- Unauthorized access to your account resulting from your failure to maintain the security of your credentials.
- Decisions you make regarding college applications, finances, or any other matter based on information found in the Service.
Indemnification
You agree to indemnify, defend, and hold harmless MyMT and its owners, operators, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your User Content.
Account Suspension and Termination
11.1 By You
You may stop using the Service and request deletion of your account at any time by contacting us.
11.2 By Us
We reserve the right to suspend or terminate your account and access to the Service, with or without notice, for any reason, including but not limited to: violation of these Terms, suspected fraudulent or abusive activity, or extended periods of inactivity. We are not liable to you or any third party for any suspension or termination of your account.
11.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may, but are not obligated to, delete your User Content after termination. Sections of these Terms that by their nature should survive termination (including Sections 6, 9, 10, and 13) will survive.
Changes to the Service
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Effective Date" at the top. We may also notify you by email or through an in-app notification.
Your continued use of the Service after updated Terms are posted constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within thirty (30) days, either party may pursue binding arbitration or, where permitted, file a claim in the state or federal courts located in Pennsylvania. You agree to submit to the personal jurisdiction of such courts.
Class Action Waiver: To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Miscellaneous
15.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and MyMT regarding the Service and supersede any prior agreements.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
15.3 No Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
15.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
15.5 Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, cyberattacks, or pandemics.
